Troy Davis, RIP

My chief reason for opposing the death penalty is that so many on death row have been proven to be innocent. Now we have a case where 77 per cent of the witnesses who testified that Troy Davis shot an off-duty cop, have now recanted their testimony and stated that the police pressured them to identify Troy Davis as the shooter. THESE ARE BAD COPS! There was no physical evidence at all to indicate that Troy was guilty. All the evidence came from witnesses, the vast majority of whom now say they lied under pressure from the police. Yet the state of georgia (it doesn't deserve to be capitalized) has now murdered a man who in all likelihood was innocent. This is not a civilized society, and georgia is not a civilized state!

I fought the ticket, Judge believed a cop who demonstrably lied under oath

I went to court today with all kinds of photos of the intersection and a diagram showing where the lights were. I was shocked when I went back to photograph the intersection when I discovered that the lights were not even in the middle of the intersection as I thought, but were outside the intersection. I distinctly remembered that I saw the light turn red while I was halfway through the intersection, just before the light went out of view. The fact that the light was located where it was means that I was past the midpoint of the intersection when the light turned red. The cop actually stated that he and the car in front of him had started moving after their light turned green, and that they had to stop when they saw the car in front of me moving into the intersection. He had already testified that the car in front of me made it through on the yellow. So he lied under oath when he said that they had to stop when they saw the car in front of me enter the intersection. I was more than halfway through the intersection before his light turned green. He clearly lied under oath--and he was placed under oath when I was. I stressed that I had a background of more than two decades as a freelance motorsports journalist, and a sterling reputation for observing cars and motorcycles in motion and accurately reporting their movements. Yet the judge believed the cop instead of me, and I don't think she had adequate reason for doing so. My testimony should have had just as much weight as his. Anybody who thinks that cops don't lie in court is just plain stupid! She found me guilty, but withheld adjudication and points from the license. I intend to obtain a copy of the tape or a transcript from the trial, since he later argued that he said they had to stop for me, not the car in front of me, so his two statements clearly disagreed with each other.

A moving violation is $101, but this ticket said the fine was $219. In spite of the fact that she withheld adjudication, she fined me $255, and another $25 fee for extended time to pay the fine. On my way to court, I stopped at a stop light and checked to see how close the Mercury Topaz was behind me, which I estimated at 1-2 feet. I carefully checked to see how much of his windshield filled my rear-view mirror, since the cop's Dodge Charger windshield completely filled my mirror, and I could clearly see the rectangular blue lights behind his windshield. The cop admitted he was close to me in court, but the judge shut me up, and said that if I wanted to press charges against the cop I would have to do so through the police agency that he worked for. The fact is, had the car in front of me put on his turn signal, and turned into a business parking lot or a side street, the cop could not have avoided hitting me. His driving was FAR more dangerous to the public than anything I did, and I insist he must be charged with following too closely and driving to endanger. I have written complaints to two people in charge of law enforcement, and gotten two cops to quit their jobs either under threat of being fired or because they could not be promoted with my letters in their file. The first one was a Massachusetts State Trooper in the sixties, and the second was in 1995, when I wrote to the Florida Department of Law Enforcement about a Gainesville cop. The police chief at the time swept it under the rug, but when a new chief came in, he ordered a review of all complaints against his officers. There were other complaints against this cop, but mine was deemed the most credible, and he was told to quit or be fired. Unfortunately the way this was done left him with no mark against his own record, and so he could go anywhere and apply for a job as a cop, as long as he left the Gainesville stint off his resume. I will be filing another complaint against this officer, including perjury as well as the driving violations. I suspect that his chief will not fire him or allow any charges to show against him, however, and apparently the FDLE has no real authority to act against a crooked cop. I suspect that if I file a lawsuit against his city, however, they would settle it out of court, since they don't want the publicity, and it might lead to copy-cat suits. I also know of another cop who regularly violates the law in his city-owned vehicle, and I will be waiting for him with a digital camera capable of making videos, and I will send that along with my complaint. That should get me noticed.

This city is paying the bills by writing questionable traffic tickets

I knew that Alachua, Florida was developing a reputation for writing lots of unnecessary traffic tickets, but I had not had a problem with them, myself, and so I continued to spend hundreds of dollars with merchants in this city, as it is the nearest metropolitan area to my home, and it has a couple of very good restaurants, a Lowes, another locally owned farm and lumber store, two supermarkets, a public library, a Dollar General, and Family dollar, a veterinarian, a computer store or three, a Radio Shack (franchise store) a Discount Auto Parts and a NAPA store and so on. In short, you can get almost anything you want here--almost like Alice's Restaurant! I have spent hundreds of dollars every month here since I moved to a nearby rural area almost nine years ago. That is, until May 31st, when one of their officers stopped me for allegedly running a red light.
I was just leaving the library, and was headed to buy some groceries, and I was the fourth car in line approaching the light, which had just turned green. I had considered taking a side street to avoid this light, but I figured it ought to accommodate four cars on the green light. The first car had plenty of time and room to move, but still he sat there. As the light changed yellow, and all three cars in front of me were moving, I figured it was a piece of cake. I was moving faster than they were, and I was easily able to enter the intersection on the yellow, pulling up almost to the bumper of the car in front of me. He took the left lane pulling out of the intersection, and I took the right lane. I did see the light turn red, but I was well into the intersection when it did so. All of a sudden I noticed a Dodge Charger about to hit me in the rear. Had I needed to hit the brakes for any reason, there is no doubt that he would have hit me. I knew instantly it was the fastest of their unmarked police cruisers. Then he flashed the lights, and I pulled into a nearby parking lot. He said he pulled me over for running the red light.  He took my license back to the cruiser, and said he would return quickly. I figured he was going to check the license for wants and warrants, and then give me a verbal warning. HAH! I should have known better. I saw him writing the ticket in my rearview mirror. When he took off, I looked at the ticket, and it showed a fine of $219.00!!!! I drive a 1995 Dodge Stratus, and my Social Security check barely covers my mortgage payment. I will have to work for the next three years until the house is paid off. I cannot afford to pay such a ticket.
Alachua is as bad as Waldo and Lawtey, trying to pay the bills by writing traffic tickets. Waldo and Lawtey gave Florida such a bad reputation, that the legislature forced them to post signs at the edge of town that speed limits are strictly enforced. Alachua is in stealth mode, here, however, as they do not enforce the speed limits so strictly, and so they do not have to have any signs posted. The do, however, hide these unmarked cruisers and motorcycle units where they can catch people who who don't slow down quickly enough at the edge of town, or in school zones. They also stop traffic on the interstate highway which goes through town for several miles. And they host events like the largest small-town 4th of July Fireworks event in the country, and the Babe Ruth League World Series, specifically to bring in tourists who they can stop for traffic violations.
I drove from where he had pulled me over, to the two stores I had been headed for, and immediately told both stores that they had lost me as a customer, due to this ticket.
I also work in retailing, so I talk to a large number of people every day. I immediately started telling people about the ticket, and ran into two retired law enforcement officers, and one guy who used to program computers for the Florida Highway Patrol. All told me that I was in the right and should fight this ticket. One told me that if my front bumper crossed the line before the light turned red, I had control of the intersection Funny, but a woman traffic court judge once told me that she did not start right up when the light turned green because she was waiting for another vehicle to clear the intersection, which would lend credence to that retired officer's statement. I also spoke with a local developer. who gave me the officer's name, which was scrawled on the ticket in an illegible manner. This developer told me he was a friend of that officer's, and that the officer had prevailed upon another cop, who had stopped the developer, to give the developer a warning instead of a ticket, which clearly shows that the officer was not interested in impartially enforcing the law.
The only way to change this kind of behavior on the part of the local government is to boycott all of the merchants in town. Don't spend any money in Alachua, don't drive through or to Alachua, and tell others to stay well away from this city. When the merchants see their income going down, because people are afraid to drive into town, they will complain to the City Commission, and this will end.
